Russell heads our highly regarded and award-winning Consumer and Motor Finance team (Best Law Firm, Car Finance Awards, 2018, 2019 and 2020).

He and his team provide specialist advisory and contentious services to a wide range of consumer, motor and asset finance providers.  Russell is a highly-regarded expert.  Clients describe him as an "expert in the industry who knows exactly what to do in any given situation", as being "very clued-up and able to give advice in a succinct, practical way” and a "shockingly clever consumer credit expert".

Russell regularly advises on highly sensitive and confidential matters which span the whole consumer and motor finance journey: from applications and permissions, to policies and procedures, to documentation, to remediations and to disputes.  Russell’s experience of both contentious and non-contentious issues means he is uniquely placed to advise on litigation risk (in an advisory context) and on compliance risk (in a litigation context).

Russell is retained by the Finance & Leasing Association to provide training to its members (including three popular and long-standing training courses).  Russell is also the author of ‘Consumer Credit: Law, Practice and Precedents’, an editor of both ‘Goode: Consumer Credit Law and Practice’ and ‘Goode: Consumer Credit Reports’ and the editor of the commentary on CONC. MCOB and BCOBS in ‘Butterworths Financial Services Regulation’.

Experience

  • Advising a whole range of consumer finance providers on highly sensitive and confidential remediation projects involving non-compliant documentation or procedures.
  • Advising a number of consumer and motor finance providers on their approach to complaints before the Financial Ombudsman Service, and claims to the Court, on a variety of issues including (a) non-disclosure of commission, (b) irresponsible lending, (c) non-compliance with regulatory rules (including responsibilities for others) and (d) unfairness.  Russell has been retained by firms threatened with mass claims and Group Litigation Orders.
  • Advising a number of mortgage lenders on their approach to claims and complaints from customers alleging non-compliance with terms and unfairness resulting from the exercise, or failure to exercise, certain rights.
  • Drafting innovative consumer finance products (including advising on documentation needed for electric vehicles and other forms of ‘green’ finance).
  • Advising the Finance & Leasing Association on lobbying both the Financial Conduct Authority and HM Treasury for change of the consumer credit framework.
