Claire’s experience includes advising on trust and estate disputes and other complexities around the administration of trusts and estates whether from a tax, legal or family dynamics perspective. 

Clients are often referred to Claire by other professionals such as tax accountants and financial advisers for a joined-up approach to their legal and financial planning.

Claire is noted by charities such as Mencap and the National Autistic Society for working with families concerned to make appropriate provision for a beneficiary with a disability or other special needs.   • Working closely with business owners passing shares in the family business to the next generation. Advising on a range of measures to help protect the shares within the family bloodline via Wills, trusts, nuptial and cohabitation agreements and changes to the company articles of association.
  • Tailoring Will and trust provision in a second marriage scenario for maximum tax efficiency and to balance provision for both new spouse and the children from the previous marriage. Taking time to understand family dynamics relevant to guiding the client through the choices to be made including choice of trustees and preparation of thoughtfully expressed letter of wishes.
  • Advising settlor of a trust on scope for removal of trustee and related practical considerations in situation where family relationships had broken down.
  • Advising attorneys under Enduring and Lasting Powers of Attorney on scope and limitations of their authority and securing approval of the Court of Protection for the making of regular gifts out of surplus income on behalf of the person lacking capacity with a view to achieving significant inheritance tax savings.
  • Helping clients achieve their philanthropic goals, including via flexible and tax efficient provision in their Wills.  Advising on complex charitable bequests or those in respect of which a dispute has arisen.
