We've advised a major UK utilities provider on various recruitment matters linked to Brexit – including meeting the requirements of the EU Settlement Scheme for current staff and an application for a Home Office Sponsor Licence.

We have advised our client in detail regarding the requirements for a Sponsor Licence under the current Immigration Rules, as well as providing advice and guidance as to how the Licence will operate when the Immigration Rules are amended in 2021.

Our client is seeking a Sponsor Licence to broaden its talent pool for filling specialist IT roles that the Home Office considers to be in shortage in the UK.  We assessed the roles that our client proposes to fill and considered these against the Shortage Occupation List requirements to establish whether Resident Labour Market Test advertising was necessary in respect of the roles.

We have also provided detailed and in-depth advice relating to the requirements of the proposed new Skilled Worker visa – in particular; how this differs with current Tier 2 (General) arrangements in terms of the categories of individual who can apply, advertising requirements, minimum skill/salary requirements and the increased flexibility that will be provided by “tradeable” points based characteristics under the proposed new rules.
