
TLT highly commended for Litigation Team of the Year at The Lawyer Awards 2024.
The accolade was awarded to TLT’s financial services disputes and investigations team that acted for Barclays in the high-profile and widely reported case of Fiona Philipp v Barclays Bank UK PLC. The case, was expedited to a hearing before the Supreme Court in 2023, where Barclays was successful in its appeal. This was the first case in which the Courts have considered the application of the Quincecare duty in the context of a paying bank’s obligations to its customers following an Authorised Push Payment (APP) fraud.
The matter was led by partner Clare Stothard and managing associate Rupal Nathwani, and has significant industry importance, providing clarity and certainty as to the relationship between a bank and its customer in respect of authorised payment transactions.
