Experience
- Advising on a high profile dispute involving a syndicated loan in relation to a high value hotel in central London. We provided advice on appointing joint fixed charge receivers over the hotel which involved in depth negotiations with five other lenders to ascertain the best recovery strategy. A sale has subsequently been agreed which will result in a significant recovery level for all lenders. We successfully pursued a substantial part of the shortfall from the customer's solicitor.
- Acting in a high value recovery action against the chairman of an Indian television company with media connections. In order to avoid adverse publicity due to serious allegations concerning the suitability of a product, we engaged in a highly structured strategy to settle the matter in pre-action negotiation. A settlement agreement was entered into against a landscape of FOS and FCA attention regarding the suitability of the product.
- Advising joint fixed charge receivers on the validity of their appointment over a care home group and subsequently dealing with the reputational issues associated with the appointment.
