Experience

  • Acted for trustees seeking the Court’s declarations as to the validity and effect of various scheme deeds.
  • Acted for trustees and the scheme employer in a substantial and highly complex professional negligence claim against its former legal advisers. The claims related to defective drafting of scheme documentation in relation to pension increases which resulted in an additional multi-million pound liability for the Scheme.
  • Acted for trustees and the scheme employer in relation to substantial claims against former advisers. The claims arise as a consequence of the advisers failing to properly advise in relation to the scope and effect of the scheme’s amendment power.
  • Advising in respect of proceedings issued for declarations as to the validity of several scheme amendments and the consequential recovery of potential substantial over payments.
