Our well-established Product Liability team is committed to protecting individuals and businesses from regulatory infringements throughout a product’s lifecycle.
The team has an enviable client base – making them one of the strongest national teams – and works predominantly with blue chip, national and international clients. Advice and representation covers food safety, product labelling, product withdrawals and recalls, product promotions and advertising.
In addition, the team can draw upon the knowledge of specialist commercial lawyers, as necessary, to provide a full commercial legal service. Product liability is a highly media-sensitive aspect of business in which we have excellent specific experience and expertise.
We understand the critical importance of our clients’ brands and we work with them to ensure that any product liability exposure does not undermine competitiveness. We defend companies against approaches from regulators in food labelling, ingredient declaration and wording, and provide advice on regulatory compliance and product recall, withdrawal and embargo.
The team has substantial expertise in regulatory compliance including dealing with the Advertising Standards Authority (ASA), Trading Standards, Food Standards Agency (FSA), Health and Safety Executive (HSE) and Environmental Health departments of local councils.
Experience
- Advising an international retailer in connection with the recall of a range of Travel Adaptors including recalls in the UK, throughout the EU and Qatar.
- Assisting a client in connection with a safety issue presented by a batch of toys where a number of samples failed the requisite metal detection tests.
- Supporting various multinationals on the cross-border implications of EU Directives and Regulations such as WEEE, RoHS and REACH.
