Experience
- Advising a syndicate of lenders in relation to it’s significant lending and security position in respect of a development finance facility made to a residential development group. We subsequently advised the lender syndicate on the successful sale of its debt on an extremely abridged timescale in challenging circumstances, as well as the agent and security agent in relation to the resignation from their roles. Our work resulted in a full, clean exit for the syndicate.
- Acting for a lender in respect of a proposed facility to the developer of a £100m student housing project. Having been purchased out of administration by a consortium of foreign investors, the developer was looking for institutional development finance. We supported our client’s real estate finance advisers providing specialist advice in relation to the lender’s security package and its enforcement rights and strategy, and in particular looking at the impact of the complex title and investment structure currently in place.
- Advising a UK lender on a contentious and sensitive exposure with secured assets situated in Scotland. This involved time critical advice on enforcement of security rights in Scotland together with the associated risk profile, alternative strategies to reduce the lender’s risk, professional negligence considerations in respect of a previously appointed advisor and complex trust arrangements and their implications on the lender’s ability to enforce and realise its security.
- Advising a lender on the restructuring of its high profile borrower’s multi-million pound lending and security position. The transaction involved the recapitalisation and acquisition of the company by a private equity firm from former owners and should ensure the company’s future and over 200 jobs.
- Acting for a payment services provider in negotiating and documenting a ground-breaking multi-million pound restructuring plan, the first of its kind following the introduction of major new legislation in response to the coronavirus pandemic. The transaction involved a complex series of creditor transactions and unique deal structures, completed in a tight timescale.
