Investigations, public inquiries and inquests

Our regulatory team regularly deals with a number of regulators and has a wide range of experience in advising clients on allegations, evidence and any regulatory or criminal liability. Some of our experts have also worked as prosecutors for government and private sector enforcement agencies, giving them well-rounded insight into these matters.

We’ll advise clients what their duties are during a public Inquiry and offer guidance on issues such as privilege against self-incrimination. We can also discuss the potential impact of any evidence they give (as well as documentary disclosures) on any future regulatory enforcement proceedings.

Our team has been involved in many different types of inquest. Some have led to prosecutions for Corporate Manslaughter, Gross Negligence Manslaughter and general Health and Safety breaches. Others have dealt with matters relating to Regulation 28 and changes to internal systems of both public and private sector organisations.

As part of any investigation, we will:

  • Undertake evidence gathering
  • Advise on matters of privilege
  • Interview witnesses (sometimes under caution)
  • Analyse documentary material
  • Advise on whether disclosures need to be made to any relevant authority.

Experience

  • Grenfell Tower Inquiry and acting for a number of senior individuals who dealt with the refurbishment of the building and other works.
  • Advising Manchester’s Metrolink in respect of an article 2 Inquest concerning the death of an individual at the hands of sub-contracted staff to the Network.
  • Advising a very large global FMCG manufacturer in respect of internal bribery allegations and sanctions relating to their Middle Eastern and other offices.
  • Acting in an investigation by the Information Commissioner's Office concerning our clients use of tracking data and the monitoring of their employees.
