Conducting compliant evaluations and moderations - avoiding the pitfalls

This webinar will address perhaps the most critical stage of a public procurement process, evaluating bids. The vast majority of procurement challenges are predicated on allegations of the use of undisclosed evaluation criteria, manifest error and unequal treatment.

In this session we will address the following:

• Setting evaluation up for success – We will talk through how the design of the evaluation/scoring criteria is critical to avoiding procurement challenge. We will look at examples of poor vs recommended approaches.
• What should a compliant evaluation process look like? – Looking at case law examples, we will explain how the lessons learned from those cases inform what a compliant evaluation/moderation process should look like.
• Feedback – We will explain the obligations of contracting authorities under the Procurement Act 2023 and share our recommendations for approaching the task of drafting assessment summaries/providing feedback more generally.

Who should attend?

We would welcome participation from both the public and private sectors. From the public sector, we anticipate that this will be of most interest to Heads of Procurement, Procurement Officers, in-house Counsel and those who may be involved in clarifying tenders and/or handling procurement challenges as part of their role. From the private sector, we envisage that this will be of interest to those who regularly bid for public sector opportunities and wish to understand more about the rules on clarification of tenders and the associated risks of a procurement challenge arising.
