The team has substantial experience in commercial regulatory issues, consumer protection regulations, and advising on advertising, contractual terms, general commercial practices, e-commerce regulations and trading regulations.

We have in-depth knowledge of consumer law issues (including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Protection from Unfair Trading Regulations 2008), Consumer Rights Act and the Ofcom General Conditions.

As well as contentious areas of work, we also advise clients and provide bespoke training on all aspects of governance, regulatory compliance and areas of consumer protection and market regulation, as well as regulatory and other disclosures.

Experience

  • Advising various national retailers and UK-wide industry bodies in connection with individual and multi-party consumer claims, including ASA complaints and investigations, around misleading acts and omissions. Similarly advising on related Trading Standards investigations and prosecutions.
  • Providing strategic advice to a European retailer in connection with an investigation by the Swedish Consumer Agency.
  • Advised an energy company on a range of product liability and compliance issues relating to a variety of issues from the placement of consumer electrical items in customers’ homes, to installation of smart meters, to commercial agreements to provide electrical generating equipment to third parties.
