We prepare and negotiate arrangements for the engagement of architects, surveyors, engineers and a broad range of other professionals providing services to the construction and property sectors. This will usually involve extension of liability to third parties by means of collateral warranties or the granting of third party rights.
We're thoroughly versed in appropriate risk allocation in such contracts and in particular the levels of risk that will be backed by consultants' professional indemnity insurers.
We're experienced in representing parties at all levels of the contractual chain, including employers and professional consultants. We act in this respect for end user and developer clients, contractor and various professionals.
We prepare and negotiate professional team appointments, usually based on our well developed precedent forms which include ancillary documents, novation agreements and collateral warranties. We're also familiar with standard form appointments published by RIBA, RICS, ACE and so on.
Our risk reviews for professional appointments highlight areas of concern and suggest practical ways of mitigating risk.
We've prepared framework arrangements for various clients who regularly procure consultants.
We have a great deal of experience in contentious work relating to consultant fee arrangements and professional negligence claims for defects in design or other breaches of professional duty.

- Advising a FTSE 250 construction company on various University and Hospital projects with regulatory bodies.
- Advising a construction group on a development scheme in Woolwich of 160 residential units, negotiating and advised on the property and planning documentation and preparing joint venture and construction documentation.
- Advising a major constructuon company on its local authority tender for the procurement of planned, reactive and capital works services worth in excess of £150 million.
