Construction claims

We strive to be an integral part of our clients’ teams, working with them to deliver their objectives. This means actively managing the interface between legal and non-legal input to ensure that the whole project is delivered, not just the legal aspects.
We have a genuine interest in our clients’ businesses and their success is a measure of our own success. Our clients tell us that they are confident to rely on TLT to work with them to identify issues and fix them.
Our knowledge of the issues faced on construction projects allows us to work alongside teams on problem projects to enable them to tackle the problems, so they can be delivered with minimum impact on project programme and budgets.
We support clients in the development, contracting, energy, nuclear decommissioning, defence and public sectors, with:
- Payment notices and notified sum issues
- Supply chain insolvency
- Programming and delay claims
- Loss and expense
- Technical defects
- Fire safety claims including Building Safety Act claims
- Termination
Under the standard forms of contracts including JCT, NEC, FIDIC, ACA as well as bespoke contracts.
The team has experience in High Court litigation, international and domestic arbitration and adjudication. However, much of our work focuses on working with our clients and their project teams to tackle issues on problem projects, protecting budgets, programmes and quality targets.
Experience
- Supporting on the decommissioning of nuclear facilities, we're advising on a series of multi-million pound disputes and potential disputes, on issues including delay, health & safety, and termination. This includes working closely with the client’s senior commercial team and project operational team, both on the issues in dispute and to assist with the ongoing project in general, as well as the procurement of new contracts. We're ensuring the best possible dispute resolution for the client whilst also assisting with management and delivery of the live project.
- We've advised a leading social housing provider operating in 125 local authority areas across England in relation to pursuing claims against insurance providers under both NHBC and Premier insurance policies. We're assisting with disputes concerning fire safety, cladding and related defects on its developments. This has involved working with its architectural expert and quantum advisers to investigate and pursue claims, including achieving declarations via adjudication to aid a claim against insurers to an insolvent building contractor.
- Representing our client on a cutting-edge research facility at a national laboratory procured under the NEC form of contract. We successfully defended delay claims brought by the main contractor in a series of adjudications and led the process into a successful settlement based on expert advice. We also advised on quality issues with process systems that were required to perform to the necessarily high standards of the laboratory.
