We can help by:
- reviewing PFI/PPP contracts to assess obligations and risks and map these against each stakeholder’s objectives for expiry. This informs the design of an exit plan, identifies whether maintenance works are required before expiry and the negotiation strategy between stakeholders;
- working with stakeholders to provide dedicated legal support, secondments and specialist commercial consultants. We can flex resources and use technology to deliver contract management support;
- planning for exit from a PFI/PPP contract requires consideration of the operating model to replace the PFI/PPP and how that will be procured. We work with contracting authorities to develop the future operating model to ensure continued operational service provision;
- understanding exit, and how it impacts service delivery, and the importance of successful mobilisation of the new service. We identify the issues that will impact PFI/PPP exit and the mobilisation of the new services.
Experience
- Advising a central government department on an integrator delivery model for FM estate services following exit from a PFI project relating to its national estate. We advised the government department on the procurement route, forms of contract for the Integrator and for supply chain providers, the commercial model including approach to KPIs and TUPE and pensions risks.
- Advising a local authority in relation to strategic planning for exit from a PFI/PPP project.
- Advising local authorities on the impacts of variations to existing PFI/PPP contracts and the effect of these variations on residual life / handback conditions on exit from the PFI/PPP contract.
