We act for central and local government departments, agencies, contractors and professional advisers on transport and infrastructure projects including:
- Design, construction and maintenance of essential transport infrastructure for road, rail, air, inland waterways and sea;
- Design and installation of electric vehicle (EV) charging infrastructure, security equipment, operational technology and intelligent transport systems;
- Disputes relating to the design and construction of transport infrastructure.
Combining an in-depth industry knowledge and a forward-thinking approach we help clients to develop innovative procurement and contracting strategies drawing on industry best practice and extensive experience with all major forms of constructing and engineering contract, including New Engineering Contracts (NEC), Infrastructure Conditions of Contract (ICC), Joint Contracts Tribunal (JCT) and FIDIC.
We support clients throughout the lifecycle of a project from developing a procurement strategy to contract exit including:
- Scoping and developing procurement strategies and contracting arrangements including flexible collaborative models and practical incentivisation;
- Supporting tender processes and live contract management;
- Distilling complex issues to provide straight forward guidance and bespoke training;
- Advising on regulatory and public law issues that impact live and prospective contracts;
- Drafting and supporting template contracts, third party agreements and finance documents;
- Avoiding and managing legal challenges or disputes.
Experience
- Advised a UK International Airport in relation to the replacement of critical security infrastructure using a variety of NEC4 forms including the Engineering and Construction Contract (ECC) for main works and PSC for various design contracts including the use of X12 (Partnering);
- Advising a Local Authority owned Contractor on several roads maintenance schemes for contractors and local authorities including using NEC in Highways Maintenance Efficiency Programme;
- Advising a building contractor in relation to a dispute concerning the construction of a highway for adoption, and utilities services under the highway.
