Our Pensions Disputes team believes in trying to avoid protracted legal engagement by seeking to resolve disputes early. This not only reduces exposure to the cost of lengthy litigation, but helps contain the situation and repair fractured relationships whether they are with members, advisers or even regulators.
Our clients include global corporates and trustees of defined benefit and defined contribution pension schemes. The team has substantial experience of dealing with disputes between trustees and employers and their advisers. We have experience of resolving significant disputes via mediation as well as proceeding via more formal court applications.
Litigation is expensive and always carries a risk. Mediation is a practical solution, but early intervention is by far the most effective means of dealing with disputes. Our pragmatic approach tackles the problem head on from the start to help diffuse the situation.
Experience
- Acting for a pensions and investment company on a portfolio of pension and retirement policy cases, including issues of unjust enrichment and mistaken payments.
- Advising pension trustees on representations to the Pensions Ombudsman following member complaints.
- Bringing Part 7 claims for professional negligence and/or breach of contract against scheme advisers including lawyers, actuaries and accountants. Advising on quantum of loss and settlement agreements.
- Advising pension scheme trustees on data protection breaches.
