Our team regularly deals with the taking and enforcing of security over real estate assets, as well as dealing with debt sales and mortgage book transfers.
We work with major lenders and funds, together with niche and sector specialist banks, insolvency practitioners and fixed charge receivers. We also act across all sectors in relation to new borrowing and refinancing transactions.
We advise on all aspects of the process for new lending, including transaction structure, due diligence, document production and regulatory matters.
Our property receivership and recoveries team is one of the largest in the UK, acting for lenders, receivers and insolvency practitioners. We deal with literally thousands of instructions annually, ranging from individual security reports and sales to major portfolios.
We always work closely with our corporate and banking teams on all property related lending and recovery matters. This means we deploy the relevant expertise in every case.
Experience
- Advising on an investment loan facility to the Victus European Student Accommodation fund. The property security comprised of two recently opened student schemes in Bristol and Liverpool providing over 500 bed spaces with a combined value in excess of £40m.
- Acting for the developer on a development finance deal with RBS to fund the development of a £25m purpose built student accommodation scheme in Bath which is scheduled for delivery in September 2016 and has been pre-sold to the Empiric Student Property fund.
- Advising on the debt purchase and property redevelopment of the Pithay in Bristol for a US based investment fund. The original debt value of over £20m was purchased for £6m and an alternative use secured for the failing office block. A sale was then agreed originally via a loan to own scheme, but latterly via a property sale for over £12m.
- Advising on a £21m facility agreement for a major North West private investment and development group and the acquisition of a substantial development site from the HCA.
