Fixed charge receivers

We advise secured lenders and fixed charge receivers throughout England & Wales and Northern Ireland. Our cross disciplinary receivership team can support on every aspect of a receivership. Our clients will always receive advice from an expert in the relevant field whether that is a member of our core receivership team or the extensive wider team who are used to dealing with insolvency issues, whether in relation to employment, commercial contracts, construction or the numerous other issues which often arise.
Our experienced team advises on issues arising from appointment and management of properties, through to disposals and beyond. From non-paying tenants and those who refuse to vacate the property at the end of a tenancy, to disputes with borrowers, our team will focus on a commercial and practical approach to find a resolution regardless of how complex or bespoke the issue.
We're used to dealing with the full range of real estate assets, from buy to let property portfolios to part build developments, shopping centres, agricultural land and estates and high net worth borrowers and their assets.
We have considerable experience advising on contentious issues that arise during the appointment of receivers or the enforcement of security. We successfully deal with injunctions against lenders and their appointed receivers on a regular basis. We also frequently address issues affecting receivers as a result of Restraining Orders and Freezing Orders against properties.
Combining our understanding of acting for lenders with unparalleled experience of advising receivers, we have long-term relationships with many of the leading receivers in the UK.

Experience
- Advising on a high profile dispute involving a syndicated loan in relation to a high value hotel in central London. We provided advice on appointing joint fixed charge receivers over the hotel which involved in depth negotiations with five other lenders to ascertain the best recovery strategy. A sale has subsequently been agreed which will result in a significant recovery level for all lenders. We successfully pursued a substantial part of the shortfall from the customer's solicitor.
- Advising joint fixed charge receivers on the validity of their appointment over a care home group and subsequently dealing with the reputational issues associated with the appointment.
- Acting for fixed charge receivers on their appointment and the disposal of a Grade II Listed period office building in central London. We have advised the receivers on methods of disposal and tax matters which included cross border and multi-party elements. The value of the deal was over £50 million.
- Acting for receivers on the appointment, estate management matters and sale of shopping centre in the home counties owned by an offshore borrower. The strategy involved dealing with Covid debt and diversifying the offering at the centre.
- Acting for receivers on a part built estate of 40+ flats and houses. As part of our appointment we dealt with building warranty issues, negotiations with the second charge holder, OER issues, dealing individual plot sales of flats and bulk sales of other plots.
